Following our recent discussions, we are delighted to offer you the opportunity to join Carolina Pintos Therapy, PLLC as Therapist. This letter outlines the terms and conditions of your engagement with Carolina Pintos Therapy, PLLC.

Compensation: 

You will be compensated at a rate of $27.00 per hour (plus tips) as a contractor. Tips are distributed from the tip pool every pay period. As an independent contractor, you are responsible for your own tax obligations. Contractors are paid on a bi-weekly basis. While our company typically conducts annual evaluations, we are open to conducting an earlier assessment to appropriately recognize and reward exceptional performance. Should your work consistently exceed expectations, we will consider an accelerated evaluation process to ensure your compensation and role within the company are aligned with your outstanding contributions.

Probation Period:

It is understood and agreed that the first ninety (90) days of employment shall constitute a probationary period during which period the Company may, in its absolute discretion, terminate your employment, for any reason without notice or cause. During this probationary period, your performance and suitability for continued employment will be monitored.

Training and Probation Period:

Upon starting your role, you will participate in an extensive training program lasting three months. This program is meticulously structured to provide you with the essential skills and expertise needed for the Post-Surgery Therapist position. The training holds a value of $4,000.

In the event of your resignation or dismissal within the initial 90-day probationary period, it is a stipulated condition of this offer that compensation for the training expenses will be recovered through the forfeiture of one or more of your paychecks. This measure aligns with the legal framework in Texas concerning the reimbursement of training expenses for employees who depart within a designated timeframe after receiving specialized training. Please note, this clause is only applicable if the termination of your contract occurs during the aforementioned 90-day probation period.

Transition to W2 Employment:

Upon completion of one year of service as a contractor, your engagement will be evaluated for potential transition to W2 employment status. Should you transition to a W2 employee, you would then become eligible for additional benefits, including medical and other benefits, in accordance with our policies for full-time employees.

Conditions:

Your contract with Carolina Pintos Therapy, PLLC is “at-will,” and is at the mutual consent of both you (as the employee) and Carolina Pintos Therapy, PLLC (as the employer), and both parties retain the right to terminate the employment relationship at will, at any time, with or without prior notice and with or without cause. At-will employment also means that Carolina Pintos Therapy, PLLC can change your position, duties, title, compensation, benefits, and/or any other terms or conditions of employment at any time, with or without notice and with or without cause. Only the owners (Homero Rubim Miranda or Carolina Pintos Miranda) have the authority, in writing signed by all parties, to make any agreement for employment on terms other than at will. This at-will employment relationship will remain in full force and effect notwithstanding any changes that may occur in your position, title, pay, or other terms or conditions of your employment with Carolina Pintos Therapy, PLLC.

You will be required to execute certain documents (i.e., Confidentiality Agreement, Non-Competition Agreement, etc.) as well as other new hire paperwork on your first day. All these documents will be visible in your employee portal, and we request that you sign all policies assigned to you no later than your 3rd day of employment. In accordance with federal law, you will be required to provide documentation verifying your eligibility to work in the United States within three (3) business days of your commencement of employment. Please be prepared to provide ORIGINAL documents on your first day of work.
